Mobile Welfare Unit Hire Agreement
These terms set out the basis on which Kwof supplies welfare units, servicing, and associated equipment to its customers.
Definitions
"Company" refers to the owner and supplier of the welfare unit.
"Customer" refers to the person or organisation hiring the equipment.
"Equipment" refers to the welfare unit or units, accessories, and associated items supplied by the Company.
"Hire Period" means the time between delivery or collection of the equipment and its return or collection by the Company.
Hire Period
The hire period begins when the equipment is delivered to the Customer's site or collected by the Customer and continues until the equipment is collected by the Company or returned to the Company's premises.
Hire charges continue until the Company confirms collection or return.
The Customer must notify the Company of any changes to the hire period or site location as soon as possible.
The Company may charge for additional hire days if the equipment is not collected or returned as scheduled.
The Company may charge for additional hire days if the equipment is used at a different site without prior agreement.
A minimum hire period may apply as stated in the quotation or agreement.
Hire Charges and Payment
Hire charges are payable at the agreed weekly or monthly rate.
The Company may invoice weekly or monthly in advance.
All invoices must be paid within the payment terms stated on the invoice.
The Company may suspend services or collect equipment if payment becomes overdue.
Delivery and Collection
Delivery and collection charges may apply unless otherwise agreed.
The Customer must ensure safe and suitable access for delivery vehicles.
If delivery or collection cannot be completed due to site conditions or access restrictions, additional charges may apply.
Customer Responsibilities
The equipment must be used safely and only for its intended purpose.
The equipment must not be modified, altered, or tampered with.
The equipment must be protected from theft, vandalism, or damage.
The equipment must be located on stable and suitable ground.
The equipment must remain accessible for servicing where applicable.
Loss or Damage
The Customer is responsible for any loss, theft, or damage to the equipment during the hire period, fair wear and tear excepted.
The Company may charge for repairs, replacement parts, or full replacement value if the equipment is lost or destroyed.
Servicing and Maintenance
Where a servicing package is included or purchased, the Company will carry out routine servicing visits including waste disposal, water refilling, cleaning, and general checks.
The Customer must ensure access to the equipment for servicing.
Failure to provide access may result in additional charges.
Breakdown or Fault
The Customer must notify the Company immediately if the equipment becomes faulty or damaged.
The Customer must not attempt repairs unless authorised by the Company.
The Company will arrange repair or replacement within a reasonable time where possible.
Site Conditions and Positioning
The Customer must ensure the site is suitable for the placement and operation of the welfare unit.
The Company is not responsible for damage to underground services, surfaces, or property caused by placement of equipment unless caused by negligence.
Insurance
The Customer is responsible for insuring the equipment against loss, theft, or damage during the hire period unless otherwise agreed in writing.
Termination of Hire
The Company may terminate the hire and recover equipment immediately if payment terms are breached.
The Company may terminate the hire if the equipment is misused or placed in unsafe conditions.
The Company may terminate the hire if the Customer enters insolvency or liquidation.
Limitation of Liability
The Company is not liable for any indirect or consequential losses arising from the use, failure, or delay in supply of the equipment.
The Company's liability will not exceed the hire charges paid for the equipment.
Collection of Equipment
The Customer must notify the Company when the equipment is ready for collection.
The equipment must be accessible for collection by a suitable vehicle.
Ownership
All equipment remains the property of the Company at all times.
Health and Safety
The Customer must ensure that the equipment is used in accordance with all relevant health and safety regulations and site rules.
Governing Law
This agreement is governed by the laws of England and Wales.
